STATEMENT ON THE INSOLVENCY ACT
If you are considering the action of making a gift of all or part of your property to one or more people – for example your spouse, partner or children, you need to be aware of the following important points.
There are specific legal provisions relating to the potential sale of your property within five years from when you complete the Deed of Gift.
If you are made bankrupt within five years of making a Deed of Gift the Law can state that you gifted your property away to avoid it being included in your bankruptcy.
You can purchase insurance to protect yourself against this potential financial situation.
To be able to purchase this type of insurance at any time between now and five years time you must have signed a declaration of insolvency and had it authorised (sworn) by a solicitor/commissioner for oaths.
